Terms of Use

These general terms and conditions apply when you as a customer order products or services from Kapell & Annat AB, via quote, webshop, email, telephone, store or other agreed method.

We want you as a customer to feel secure throughout the entire process. If you have any questions about your order, assembly, delivery or complaint, you are always welcome to contact us.

1. Order and agreement

An order becomes binding when we have confirmed the order in writing, for example via email, offer acceptance or order confirmation. Orders placed by telephone or in person are also binding.

For custom-made products, for example Boat canopies , spray hood, Cockpit Tent , Winter Cover , cushions, mattresses, Sail cover , sails, sailpacks or other custom-made products, production begins differently depending on the approach and the ordered item. This may involve template making, measuring, ordering materials, production or other preparation.

As a customer, you are responsible for ensuring that the information you provide is correct, such as boat model, year, dimensions, color choice, material choice, delivery address and contact information.

2. Quotes and prices

All prices are stated in Swedish kronor including VAT, unless otherwise stated.

A quote is valid for the period specified in the quote. If no validity period is specified, the quote is valid for 30 days from the quote date.

The price is based on the information available at the time of the quote. If the conditions change, for example through changed dimensions, options, material selection, extra work or special customer requests, the price can be adjusted by agreement.

3. Custom-made products

Many of our products are manufactured specifically for a specific boat or according to the customer's wishes. This applies to products that are templated, sewn, cut, embroidered or adapted to the boat model, existing fittings, frames , color choice or customer measurements.

Since these products cannot normally be resold to another customer, special rules apply for cancellation and right of withdrawal, see points 8 and 9.

4. Customer responsibilities prior to sampling or visit

When visiting a boat, modeling or assembly, the customer is responsible for ensuring that the boat is accessible, safe and prepared according to our instructions.

This means, among other things, that the boat should be properly moored, easy to board and that work areas should be free of loose objects. During winter, snow and ice should be removed. If the boat is not available or safe at the booked time, additional costs may apply.

5. Delivery time

Delivery time varies depending on product, season, material availability and workload.

The stated delivery time is an estimate and may be affected by factors such as weather, waiting for customer approval, staff illness, changed requests, material deliveries or other circumstances beyond our control.

We will notify the customer if we assess that the delivery will be significantly delayed.

6. Delivery and shipping

Delivery takes place as agreed, for example by collection from us, shipping to the customer or other agreed delivery solution.

When shipping, the customer is responsible for checking the shipment upon receipt. Visible transport damage must be reported directly to the carrier and to us as soon as possible.

Shipping costs are added unless otherwise stated.

7. Payment

Payment is made according to the payment terms stated on the quote, order confirmation, invoice or in the webshop.

For larger or custom orders, advance payment, partial payment or down payment may be required before work begins.

In the event of late payment, we have the right to charge late payment interest and any statutory fees.

8. Cancellation

Cancellation of universal products can be made before the goods have been shipped or collected, unless otherwise agreed.

For custom-made products, cancellations can only be made before work has begun. If work, ordering materials, patterning, cutting, sewing or other customization has already begun, we have the right to charge the customer for work done, ordered materials and other costs.

9. Right of withdrawal

When purchasing remotely, consumers normally have a 14-day right of withdrawal according to the Distance Contracts Act. The Swedish Consumer Agency describes that the right of withdrawal as a general rule applies to purchases made remotely, for example via the internet or telephone.

However, the right of withdrawal does not normally apply to goods that have been manufactured according to the customer's instructions, for a specific boat model, or that have been given a clear personal touch, such as specially sewn awnings, custom-made cushions, embroidered products or other customized products. Svensk Handel describes this exception for specially manufactured goods.

For universal products that are not specially manufactured, the right of withdrawal applies according to law, provided that the product is returned in a substantially unchanged condition.

10. Complaints

If you believe that a product or service is faulty, you should contact us as soon as possible after discovering the fault.

As a consumer, you have a right to complain for 3 years according to the Consumer Sales Act. The Swedish Consumer Agency also states that complaints must be made within a reasonable time, and that complaints made within 2 months of the defect being discovered are always considered to be within a reasonable time.

When making a complaint, please describe the error clearly and attach pictures if possible. This will help us assess the matter more quickly and find the best solution.

If the complaint is approved, we will remedy the defect in accordance with applicable law, for example through repair, adjustment, replacement, price reduction or other appropriate solution. We reserve the right to determine which solution is most appropriate in the individual case.

11. Warranty and life expectancy

We work with high-quality materials and manufacturing methods and strive for long-term durability.

Any warranty is stated in the order confirmation, product information or separate warranty terms. Warranty does not affect your statutory rights. The Swedish Consumer Agency clarifies that warranty is voluntary, but that the consumer always has the right to complain according to law regardless of whether a warranty exists or not.

The lifespan of the canopy, windows, seams, fittings and other parts is affected by use, weather, UV light, care, winter storage, washing and maintenance.

12. Assembly and fit

Our products are manufactured with great care. For the best fit, it is important that assembly is carried out according to the instructions provided and that all fittings, frames , straps and fasteners are used correctly.

If something does not look right during assembly, please contact us before making your own changes, moving fittings or modifying the product. Please send pictures or videos so that we can help you in the best way possible.

13. Care and maintenance

For the product to last a long time, it needs to be cared for according to our care instructions. Canopies should be kept clean, ventilated and free from dirt, bird droppings, mold and unnecessary strain.

Incorrect washing, dry cleaning, strong cleaning agents, lack of maintenance, incorrect storage or external influences can affect the product's lifespan and are normally not covered by the right of complaint.

14. Repairs and laundry

When repairing used awnings, we normally require that the awning is professionally washed before the work is carried out. This is done to protect our working environment, our machines and ensure a good result.

Repairs are charged as agreed, usually based on labor time, materials, and any shipping.

15. Color, material and minor deviations

Colors may appear different depending on screen, light, material and dye bath. Minor color differences, material variations or normal tolerances in fit and stitching may occur and are not considered defects if the product otherwise corresponds to the order.

When adding to older awnings, new fabric, new panes or new details may differ slightly from existing material that has been exposed to sun, weather and wear.

16. Archived templates

When we manufacture a product Custom Made We save the template and product information in our archive to simplify future orders. This means that in many cases you can order the same or similar product again at a later time.

We reserve the right to change or supplement the chapels without our knowledge and to frames may have changed over time, which may affect the fit when ordering a new one.

17. Personal data

We process personal data needed to handle quotations, orders, deliveries, payments, customer service, complaints and future service.

Examples of information we may process include name, address, telephone number, email address, boat model, order history and information linked to ordered products.

18. Force majeure

We are not responsible for delays or obstacles due to circumstances beyond our control, such as natural disasters, fire, war, strikes, government decisions, illnesses, transportation disruptions, supplier problems, power outages or other similar events.

19. Dispute

We always strive to resolve any problems directly with the customer.

If a dispute cannot be resolved between us, consumers can turn to the Swedish National Board of Complaints, ARN. We follow ARN's recommendations.

Swedish law applies to purchases from Kapell & Annat AB.
